This disclaimer is part of the AlchemCharts legal terms and should be read together with the Terms of Service, Privacy Policy, market data agreements, exchange agreements, and any notices presented when you subscribe, download, install, or use AlchemCharts.

If you do not understand or agree with this disclaimer, do not use AlchemCharts for trading or investment-related decisions.

Section 2

No Investment, Trading, Financial, Legal, Tax, or Regulatory Advice

AlchemCharts is provided for software, charting, educational-support, informational, account, and market data display purposes only. AlchemCharts does not provide investment advice, trading advice, financial advice, tax advice, legal advice, regulatory advice, professional subscriber classification advice, brokerage services, order execution, custody, clearing, market-making, or portfolio management services.

No chart, indicator, alert, workspace, scan, list, layout, data display, support response, email, screenshot review, documentation, website content, setup instruction, or other AlchemCharts material should be treated as a recommendation, instruction, endorsement, or solicitation to buy, sell, hold, trade, hedge, avoid, or otherwise transact in any security, commodity, option, future, cryptocurrency, index, ETF, fund, strategy, account type, or financial product.

AlchemCharts does not review your personal finances, trading objectives, investment objectives, risk tolerance, tax situation, legal obligations, regulatory status, portfolio, account size, experience level, or suitability for any trade, investment, product, or strategy.

Section 3

No Broker, Adviser, Fiduciary, or Professional Relationship

AlchemCharts is not a broker-dealer, investment adviser, futures commission merchant, commodity trading advisor, commodity pool operator, introducing broker, exchange, clearing firm, tax advisor, accounting firm, law firm, or financial institution.

Your use of AlchemCharts does not create a broker-client, adviser-client, fiduciary, attorney-client, accountant-client, tax-advisor, or other professional advisory relationship with AlchemCharts, its owners, employees, contractors, affiliates, licensors, data providers, or service providers.

AlchemCharts Support can help with software, account, billing, installation, login, market data forms, blank charts, missing data, and basic navigation issues. Support cannot make decisions for you or provide advice that depends on your personal circumstances.

Section 4

Your Decisions and Responsibility

All trading, investing, tax, legal, regulatory, and financial decisions are your responsibility. You alone are responsible for deciding whether to open, close, hold, size, hedge, manage, or avoid any position or transaction.

You are responsible for understanding the risks of the products and markets you trade, confirming information before relying on it, using appropriate risk controls, reviewing official disclosures, and consulting qualified professionals before making decisions that depend on your circumstances.

You should not trade or invest money you cannot afford to lose. You should not rely on AlchemCharts as your sole source of information for any trading or investment decision.

Section 5

General Market and Investment Risks

Trading and investing involve risk. Markets can be volatile, unpredictable, illiquid, interrupted, or affected by events beyond your control, including economic news, earnings, interest rates, inflation, exchange actions, geopolitical events, regulatory changes, technology failures, trading halts, liquidity changes, corporate actions, and market sentiment.

Risks may include, without limitation:

  • Loss of some or all invested capital.
  • For certain products, losses greater than the amount initially invested.
  • Rapid or unexpected price changes, gaps, slippage, and execution risk.
  • Liquidity risk, including inability to enter, exit, or adjust positions at expected prices.
  • Volatility risk, leverage risk, margin risk, assignment risk, settlement risk, counterparty risk, and operational risk.
  • Data, connectivity, exchange, platform, broker, or provider outages.
  • Errors in user judgment, order entry, position sizing, timing, interpretation, or risk management.

Section 6

Product-Specific Risks

Different financial products have different risks. You are responsible for reviewing product-specific disclosures and understanding the risks before trading.

  • Stocks and ETFs may decline in value, become volatile or illiquid, be affected by issuer-specific events, or fail to track expected benchmarks.
  • Options involve significant risk and are not suitable for every investor. Options can expire worthless, move rapidly, involve assignment or exercise risk, and create complex exposure.
  • Futures, commodities, and leveraged products can involve substantial risk, margin calls, rapid losses, and losses that may exceed deposits or initial investment.
  • Indexes are not directly investable and may be calculated, adjusted, delayed, or displayed under rules set by third parties.
  • Cryptocurrency and digital asset markets may involve extreme volatility, regulatory uncertainty, cybersecurity risks, custody risks, fraud risks, liquidity risks, and platform or counterparty failures.
  • Short selling, margin, spreads, multi-leg strategies, leveraged strategies, inverse products, and complex products can increase risk and may not behave as expected.

AlchemCharts does not determine whether any product, market, account, strategy, or trade is suitable for you.

Section 7

Charts, Indicators, Alerts, and Market Data Are Tools, Not Guarantees

AlchemCharts may display market data, charts, historical information, intraday data, end-of-day data, options data, futures data, index data, crypto data, earnings, splits, fundamentals, indicators, alerts, notes, watchlists, and other information from exchanges, data providers, licensors, or other third parties.

Charts, indicators, alerts, scans, watchlists, layouts, and market data are tools for review. They are not predictions, guarantees, recommendations, or instructions. They can be wrong, late, incomplete, misconfigured, misunderstood, or unavailable.

Market data and third-party information may be delayed, missing, incomplete, inaccurate, corrected, adjusted, interrupted, unavailable, or discontinued. Corporate actions, symbol changes, exchange rules, provider limitations, account status, entitlement status, user settings, internet connections, device issues, or software issues may affect what you see.

You are responsible for independently verifying information before relying on it. AlchemCharts does not guarantee the accuracy, completeness, timeliness, sequence, availability, suitability, or usefulness of any data, chart, indicator, alert, or third-party information.

Section 8

Software Support Is Not Trading Advice

AlchemCharts Support may help with account access, downloads, installation, updates, login, password reset, billing, cancellation, market data forms, blank charts, missing data, setup resources, and basic software navigation.

AlchemCharts Support cannot tell you what to buy, sell, hold, trade, hedge, avoid, or risk. Support cannot evaluate whether a chart setup is a good trade, whether a position should be entered or exited, whether a strategy is appropriate, how much money to risk, whether a trade will be profitable, or how you should answer questions that require legal, tax, regulatory, financial, professional classification, or investment judgment.

If a support response appears to discuss charts, symbols, indicators, data, or software behavior, it is intended only to help with software use and should not be treated as advice or a recommendation.

Section 9

Market Skills Education Is Separate

Market Skills education, where applicable, is separate from AlchemCharts software support. Market Skills may provide educational materials or strategy instruction outside of AlchemCharts. AlchemCharts provides charting software, market data display, account tools, setup resources, and software support.

AlchemCharts does not guarantee any outcome from Market Skills education, any trading method, any workspace, any indicator, any chart layout, any data package, or any user's application of those materials.

Past student experiences, training examples, screenshots, testimonials, demonstrations, or educational references should not be treated as promises, predictions, or guarantees of future results.

Section 10

Market Data Agreements and Exchange Forms

Some market data access may require exchange agreements, professional or non-professional classification, subscriber information, audit records, entitlement checks, or other information required by exchanges, licensors, or data providers.

You are responsible for answering market data forms accurately and truthfully. Do not guess. AlchemCharts Support may help explain the form process, but it cannot answer forms for you or provide legal, tax, regulatory, financial, professional classification, or investment advice.

Data providers, exchanges, or licensors may require AlchemCharts to limit, suspend, correct, audit, report, or terminate access. AlchemCharts may do so without liability to you.

Section 11

Examples, Backtesting, Simulations, and Past Performance

Any examples, screenshots, sample charts, historical references, backtests, simulations, demonstrations, paper trading references, hypothetical examples, or educational illustrations are for informational and software-use purposes only.

Past performance, historical examples, hypothetical results, simulated results, paper trading results, or backtested results do not guarantee future performance. Real-world trading can differ materially because of execution, liquidity, slippage, commissions, fees, taxes, data differences, emotional factors, account constraints, and market conditions.

AlchemCharts does not promise profits, risk reduction, success rates, win rates, income, returns, or suitability for any user.

Section 12

Availability, Errors, and User Configuration

AlchemCharts, market data, account tools, downloads, software updates, support resources, and related services may be unavailable, delayed, interrupted, changed, limited, or discontinued. Maintenance, outages, internet problems, data provider issues, exchange issues, device problems, account status, payment status, entitlement status, security software, operating system changes, or user settings may affect use.

You are responsible for configuring, reviewing, and confirming your own workspace, symbols, data permissions, alerts, notes, layouts, charts, indicators, and account settings. AlchemCharts is not responsible for trading or investment losses caused by user settings, device issues, interpretation, reliance, delayed action, missed alerts, missing data, or unavailable service.

Section 13

Additional Investor Education Resources

Official investor education resources may help you understand market and product risks. AlchemCharts does not control these resources and does not provide legal, financial, or investment advice by linking to them.

  • Investor.gov, maintained by the U.S. Securities and Exchange Commission, provides investor education materials and alerts.
  • FINRA options resources explain that options can involve significant risks and are not suitable for every investor.
  • CFTC futures market basics provide general education about futures markets and related risks.
  • SEC crypto asset investor alerts discuss risks connected to crypto asset securities and related markets.

Section 14

Changes to This Disclaimer

AlchemCharts may update this Risk and Investment Disclaimer from time to time. The updated disclaimer will be posted on the website with a new last updated date. If a change is material, AlchemCharts may provide additional notice by email, account notice, website notice, or another reasonable method.

Your continued use of AlchemCharts after an updated disclaimer takes effect means you acknowledge the updated disclaimer.
