These Terms govern access to the AlchemCharts website, account area, software, subscription, support, and related services.
These Terms of Service govern your access to and use of AlchemCharts, including the website, account area, software, subscription, support, market data setup, and related services.
This overview is for convenience only. The full Terms below control if there is any conflict.
These Terms govern access to the AlchemCharts website, account area, software, subscription, support, and related services.
AlchemCharts Complete is billed monthly unless cancelled and confirmed, subject to the subscription terms below.
Market data access may require exchange agreements, accurate subscriber information, and active account status.
AlchemCharts provides charting software and support, not investment, trading, legal, tax, or regulatory advice.
Section 1
These Terms of Service, together with any policies, notices, order pages, subscription terms, market data agreements, and other documents that reference these Terms, form a legal agreement between you and AlchemCharts, LLC ("AlchemCharts," "we," "us," or "our").
By accessing or using the AlchemCharts website, creating an account, subscribing, downloading or using the software, submitting a support request, or otherwise using the services, you agree to these Terms. If you do not agree, do not use AlchemCharts.
If you use AlchemCharts on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.
Section 2
AlchemCharts provides charting software, website pages, account tools, subscription access, setup resources, market data setup workflows, support resources, and related services for users of the Market Skills workflow.
AlchemCharts may include chart layouts, indicators, notes, watchlists, data displays, support content, downloadable files, account dashboards, billing pages, and related features. Features may change over time, and some features may require an active subscription, supported hardware or software, internet access, market data agreements, or account approval.
AlchemCharts is a software and information tool. It is not a broker-dealer, investment adviser, futures commission merchant, commodity trading advisor, tax advisor, law firm, exchange, clearing firm, or financial institution.
Section 3
You must be at least 18 years old and legally able to enter into these Terms to use AlchemCharts. The service is intended for Market Skills students and users who need the official Market Skills charting workspace.
You are responsible for ensuring that your use of AlchemCharts is lawful in your location and consistent with any applicable exchange, data provider, brokerage, employer, school, or professional requirements.
Section 4
You may need an account to subscribe, download software, access market data setup, request support, or use certain features. You agree to provide accurate, current, and complete account information and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your account or password with anyone. AlchemCharts Support will never need your password.
You agree to notify AlchemCharts promptly if you believe your account, password, payment method, or market data access has been compromised or used without authorization.
Section 5
AlchemCharts Complete is a paid monthly subscription. The current public price shown on the site is $195 per month unless a different price is presented to you at checkout or in your account.
By starting a paid subscription, you authorize AlchemCharts and its payment processors to charge your payment method for recurring subscription fees, applicable taxes, and any other amounts you authorize. Billing continues until the subscription is cancelled and confirmed.
You must keep a valid payment method on file. If a charge fails, AlchemCharts may retry the charge, request updated payment information, suspend access, terminate access, or take other reasonable steps to collect amounts owed.
Prices, plans, features, data packages, and billing practices may change. If required, AlchemCharts will provide notice before material changes take effect. Continued use after a change takes effect means you accept the change.
Unless expressly stated otherwise or required by law, fees are non-refundable and are not prorated for partial billing periods, unused access, setup delays, market data agreement delays, user hardware issues, user internet issues, or a user's decision not to use the service.
Section 6
You may cancel your subscription through the account billing area where available or by contacting AlchemCharts Support using the email address connected to your account. If support processes your cancellation, your cancellation is complete when AlchemCharts confirms it in writing or in your account.
A question, complaint, setup request, refund request, support conversation, voicemail, bounced email, or incomplete form is not a completed cancellation unless cancellation is specifically requested and confirmed. Keep your cancellation confirmation for your records.
Cancellation stops future renewal charges after the cancellation is processed. It does not automatically refund prior charges unless AlchemCharts agrees in writing or a refund is required by law.
Section 7
Subject to your compliance with these Terms, AlchemCharts grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the AlchemCharts software for your personal Market Skills student workflow during the period when your account is active and in good standing.
You may not copy, sell, rent, lease, sublicense, distribute, publicly display, host, outsource, reverse engineer, decompile, disassemble, modify, create derivative works from, bypass access controls for, interfere with, or attempt to extract source code from AlchemCharts, except to the extent applicable law does not allow those restrictions.
You may not share installers, license files, credentials, activation information, account access, market data access, or non-public downloads with anyone else. AlchemCharts may require updates, disable old versions, or change supported versions for security, compatibility, legal, or operational reasons.
Section 8
AlchemCharts may display market data, quotes, charts, historical information, options information, futures information, index information, cryptocurrency information, earnings, splits, fundamentals, news, or other information from exchanges, data providers, licensors, or other third parties.
Market data access may depend on active subscription status, account setup, accurate subscriber information, exchange approvals, completed agreements, non-professional or professional classification, geographic location, system availability, provider availability, and other requirements.
You are responsible for answering market data agreements accurately. Do not guess. AlchemCharts Support may help explain the form process, but it cannot provide legal, regulatory, tax, financial, professional classification, or investment advice, and it cannot answer exchange forms for you.
Market data and third-party information may be delayed, missing, incomplete, inaccurate, interrupted, misclassified, adjusted, corrected, unavailable, or discontinued. You may not redistribute, resell, publish, scrape, download in bulk, or otherwise misuse market data or third-party information unless expressly permitted by the applicable provider agreement.
If a data provider, exchange, or other third party requires AlchemCharts to limit, suspend, correct, audit, report, or terminate access, AlchemCharts may do so without liability to you.
Section 9
AlchemCharts is provided for educational, informational, and software-use purposes only. AlchemCharts does not provide investment advice, trading advice, financial advice, tax advice, legal advice, regulatory advice, professional subscriber classification advice, trade recommendations, brokerage services, order execution, custody, or market-making services.
No chart, indicator, workspace, market data display, support response, website content, email, training reference, or other AlchemCharts material should be treated as a recommendation to buy, sell, hold, trade, hedge, or avoid any security, commodity, option, future, cryptocurrency, investment, strategy, account type, or financial product.
Trading and investing involve risk, including possible loss of principal. You are solely responsible for your trading, investing, tax, legal, regulatory, and financial decisions. Consult qualified professionals before making decisions that depend on your personal circumstances.
Market Skills education, where applicable, is separate from AlchemCharts software support. AlchemCharts Support helps with software, account, billing, setup, and data access issues, not trading decisions or strategy interpretation.
Section 10
If you contact support, you authorize AlchemCharts to use the information you provide to investigate, respond to, document, and resolve your request. This may include your account email, issue description, screenshots, files, logs, billing context, device information, or other information you choose to submit.
Do not send passwords, full credit card numbers, unnecessary personal information, or unrelated private information through support forms, email, screenshots, or messages.
You represent that you have the right to submit any information you provide. You grant AlchemCharts a limited right to use, reproduce, store, display, and share your submissions internally or with service providers as needed to operate, secure, support, improve, or document the services.
Section 11
You agree not to misuse AlchemCharts. Prohibited conduct includes:
The Acceptable Use Policy provides additional user guidelines and is incorporated into these Terms.
Section 12
AlchemCharts and its licensors own all rights, title, and interest in and to the services, software, website, designs, interfaces, graphics, logos, names, documentation, workflows, layouts, text, code, databases, and other materials, except for content owned by third parties or information you provide.
No rights are granted except as expressly stated in these Terms. AlchemCharts, the AlchemCharts name, and related marks may not be used without written permission. Other names and marks belong to their respective owners.
If you provide feedback, suggestions, ideas, or requests, AlchemCharts may use them without restriction or compensation to you.
Section 13
AlchemCharts handles account, billing-related, support, setup, and usage information as described in the Privacy Policy and privacy summary. By using AlchemCharts, you consent to receiving transactional, account, billing, support, security, service, and administrative communications.
You agree that notices may be provided electronically by posting on the website, displaying in your account, or sending to the email address associated with your account. You are responsible for keeping your email address current.
Section 14
AlchemCharts may rely on third-party services such as payment processors, hosting providers, email providers, analytics tools, data providers, support tools, exchanges, licensors, or linked websites. Third-party services are not controlled by AlchemCharts and may have their own terms, fees, privacy practices, availability, and restrictions.
AlchemCharts is not responsible for third-party websites, services, content, data, actions, omissions, or failures, except to the extent required by law.
Section 15
AlchemCharts may update, modify, suspend, discontinue, limit, or replace any part of the services at any time. The services may be interrupted by maintenance, updates, outages, data provider issues, network problems, account issues, security events, legal requirements, or other causes.
AlchemCharts does not guarantee that the services, website, software, support, downloads, market data, account area, or any feature will be uninterrupted, error-free, secure, current, compatible with all systems, or available at all times.
Section 16
AlchemCharts may suspend or terminate access, disable accounts, remove content, limit features, or refuse service if AlchemCharts believes that you violated these Terms, failed to pay, created risk for AlchemCharts or others, provided inaccurate information, misused market data, violated third-party requirements, or used the services in a way that may cause legal, security, operational, or reputational harm.
You may stop using AlchemCharts at any time, but stopping use does not automatically cancel a paid subscription. Subscription cancellation is governed by the cancellation section above.
Sections that by their nature should survive termination will survive, including payment obligations, ownership, restrictions, disclaimers, liability limits, indemnity, governing law, and general provisions.
Section 17
To the maximum extent permitted by law, AlchemCharts and its owners, officers, employees, contractors, affiliates, licensors, data providers, and service providers provide the services "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
To the maximum extent permitted by law, AlchemCharts disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, compatibility, and uninterrupted or error-free operation.
AlchemCharts does not warrant that market data, charts, indicators, account information, support information, billing information, software, downloads, or website content will be accurate, complete, timely, secure, available, or free from defects, viruses, vulnerabilities, or harmful components.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
Section 18
To the maximum extent permitted by law, AlchemCharts and its owners, officers, employees, contractors, affiliates, licensors, data providers, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, lost profits, lost revenue, lost data, lost opportunities, trading losses, investment losses, business interruption, or cost of substitute services, even if advised of the possibility of those damages.
To the maximum extent permitted by law, the total aggregate liability of AlchemCharts and its owners, officers, employees, contractors, affiliates, licensors, data providers, and service providers for all claims arising out of or related to the services or these Terms will not exceed the greater of $100 or the amount you paid to AlchemCharts for the services in the three months before the event giving rise to the claim.
The limitations above apply to all theories of liability, including contract, tort, negligence, strict liability, warranty, statute, and any other legal theory, to the extent permitted by law. Some jurisdictions do not allow certain limits, so some limits may not apply to you.
Section 19
You agree to defend, indemnify, and hold harmless AlchemCharts and its owners, officers, employees, contractors, affiliates, licensors, data providers, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the services, your account, your submissions, your trading or investment decisions, your violation of these Terms, your violation of law, your violation of third-party rights, or your misuse of market data or third-party information.
Section 20
AlchemCharts may update these Terms from time to time. The updated Terms will be posted on the website with a new last updated date. If a change is material, AlchemCharts may provide additional notice by email, account notice, website notice, or another reasonable method.
Your continued use of AlchemCharts after updated Terms take effect means you accept the updated Terms. If you do not agree to updated Terms, you must stop using AlchemCharts and cancel any paid subscription.
Section 21
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules. Subject to any rights you may have under applicable law, you agree that any dispute arising out of or related to these Terms or AlchemCharts will be brought exclusively in the state or federal courts located in or serving Arlington County, Virginia, and you consent to personal jurisdiction and venue there.
Before filing a claim, you agree to contact AlchemCharts through our contact form and attempt in good faith to resolve the dispute informally, unless doing so would be unlawful or would prevent you from seeking urgent legal relief.
Section 22
These Terms, together with the policies and documents incorporated by reference, are the entire agreement between you and AlchemCharts regarding the services and replace prior or contemporaneous agreements about the same subject.
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect, and the invalid or unenforceable provision will be replaced or interpreted to best accomplish its original purpose to the extent permitted by law.
AlchemCharts may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law. You may not assign or transfer these Terms or your account without written permission. Failure to enforce a provision is not a waiver. Neither party is responsible for delay or failure caused by events beyond reasonable control.
Section 23
Questions about these Terms can be sent to AlchemCharts Support through our contact form.
If billing, cancellation, market data forms, setup, or support boundaries are unclear, contact AlchemCharts Support before subscribing.
